En 24 municipios bonaerenses Mega operativo para controlar las condiciones de trabajadores de aplicaciones de delivery
Es una de las actividades donde se registra mayor vulnerabilidad de los derechos laborales
En 24 municipios y de manera simultánea, el ministerio de Trabajo bonaerense realizó un
mega operativa de inspección con el fin de controlar la registración, condiciones laborales y de
Seguridad y Salud de las y los trabajadores de plataformas digitales de delivery.
Este operativo, inédito por su alcance territorial, es una acción más de la cartera laboral
provincial que busca avanzar en el reconocimiento de los derechos laborales de miles de
bonaerenses que trabajan con estas aplicaciones de reparto en toda la Provincia. Trabajadores
y trabajadoras que a pesar de cumplir con todas las obligaciones de cualquier empleado en
relación de dependencia, en su mayoría no están registrados y no cuentan con ningún tipo de
protección en materia de Salud y Seguridad, dejando en evidencia la imposibilidad de acceder,
por ejemplo, a los beneficios previsionales.
Las apps de delivery se autodefinen como empresas de tecnología que únicamente
proporcionan una herramienta informática que conecta individualmente a proveedores de
servicios con los consumidores, encubriendo de esta manera la relación laboral que tienen con
decenas de miles de personas que deben registrarse como monotributistas o autónomos. De
esta manera no cuentan con un sueldo básico, pero deben cumplir un horario estipulado, una
cierta cantidad de horas diarias y, aunque no tengan lugar físico ni fijo de trabajo, deben
concentrarse en zonas específicas en donde reciben los pedidos para realizar.
Los y las inspectoras del Ministerio realizaron los relevamientos en zonas de concentración de
locales gastronómicos y en centros de distribución de las empresas en los distritos de
Almirante Brown, Avellaneda, Lanús, Quilmes, Berazategui, Lomas de Zamora, La Plata, La
Matanza, Morón, San Isidro, San Martín, Tres de Febrero, Campana, José C. Paz, San Miguel,
Zarate, Pilar, Pinamar, Azul, Junín, Mar del Plata, Necochea, Tandil y Bahía Blanca.
“Es una buena noticia que ahora exista una verdadera discusión sobre la situación muy
precaria de estos trabajadores que salen a la calle sin una cobertura de nada y que algunos se
pagan ellos mismos un seguro de accidentes personales porque si les pasa algo nadie los
cubre”, afirmó al repsecto la ministra Mara Ruiz Malec. Y agregó: “el Estado debe estar
protegiendo a los trabajadores frente a estas apps que a pesar de ser millonarias les niegan los
derechos más básicos. Ser registrado es un cambio sustancial en las condiciones laborales y de
vida de cada uno porque no es lo mismo tener obra social que no tenerla, saber que estás
aportando a una caja para tu futura jubilación que no hacerlo”.
Estas inspecciones del ministerio de Trabajo comenzaron en 2020, cuando se realizó un primer
relevamiento de 172 trabajadores y trabajadoras y se intimó a las empresas a presentar la
documentación laboral de los mismos, las cuales desconocieron la relación de dependencia.
Esa acción culminó con sanciones aplicadas por el Ministerio ante la falta de registración y
otros tipos de incumplimientos a la normativa laboral.
Las multas fueron ratificadas por la Justicia de La Plata, confirmando la existencia de relación
de dependencia y validando el accionar de la cartera laboral. Por esto, con esta doble jornada
de inspecciones lo que se buscó fue profundizar el alcance de aquella primera intervención en
pos de reconocer los derechos laborales que le corresponden a estos trabajadores y
trabajadoras bonaerenses.
